Stopping foreclosure

Behind on the mortgage? There may still be time.

A foreclosure can feel like a clock you cannot stop. A bankruptcy filing can: when we file, the automatic stay usually halts the sale, even one set for next week. It buys time rather than a permanent fix, so the first call is about what you want to happen with the house.

If you want to keep it, Chapter 13 lets you spread the missed payments over up to five years while you stay current on the regular payment. If you would rather leave, a filing can stop the sale, clear what you would still owe and give you time to move without a sale date hanging over you. A loan modification may also be worth asking your lender about, and we will say so when it fits.

Bring to the first call

  • A notice of default, or a letter from the lender

  • The date of any scheduled sale

  • Your last mortgage statement and a recent pay stub

What happens, and how fast

The sale date sets the pace. The sooner you call, the more choices you have.

  1. 01

    Step 1: Read the dates

We read your notices together and find the dates that matter: the default, the sale and any deadline to respond.

  2. 02

    Step 2: Choose a path

Keep the home with a Chapter 13 plan, or leave on your terms. We lay out both with the monthly numbers.

  3. 03

Step 3: File before the sale

We file as fast as the papers allow, and notify the lender and the foreclosure trustee so the sale is called off.

  4. 04

Step 4: Work out the home

With the sale on hold, you catch up through the plan, or use the time to move, sell or negotiate with the lender.

Foreclosure questions

When the sale date is close

My sale date is close. Is it too late?

Often it is not, but every day matters. Call or text today and tell us the date on your notice.

Will I lose the house if I file?

Not because of the filing. Chapter 13 is built for people who want to keep the home and catch up over time.

Can I still ask for a loan modification?

Yes. A filing can give you time to pursue one. We will tell you honestly if it looks unlikely.

What if I want to leave the house?

A filing can stop the sale and clear what you would otherwise still owe, so you can move on your schedule.
